Operator: Atelier Studio, a New York LLC (“Atelier,” “we,” “us,” or “our”)

1. Agreement

These Terms of Service (“Terms”) govern your use of the Service. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Atelier Studio is a personal wardrobe tool. You sign in, upload photos of clothing, and we help you organize items and suggest outfits. Some features use third-party AI services. Shop similar may show links to third-party retailers for visually similar items. We do not sell those items, and we do not control their sites, prices, or stock.

The Service is currently provided without charge. We may add, change, or discontinue features, or introduce paid plans, with notice as required by law. We do not promise that the Service will be uninterrupted or error-free.

The Service is for your personal, non-commercial use. It is not a social network, marketplace, or professional styling service.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If we learn that an account belongs to someone under 18, we will close it.

4. Accounts

You sign in with Google. You are responsible for your Google account and for activity on the Service under that account. Keep your sign-in credentials secure. Tell us promptly at admin@atelierstudio.ai if you believe your account has been used without permission.

We may suspend or close an account if we believe these Terms have been violated, if we are required to do so by law, or if we stop offering the Service.

You may delete items in the app. To close your account, email admin@atelierstudio.ai from the address on the account.

5. Your content

You keep whatever rights you already have in the photos and other material you submit (“Your Content”). You grant Atelier a limited license to host, process, and display Your Content, and to send it to our service providers, solely as needed to operate and improve the Service for you.

You represent that:

you have the right to upload Your Content;
Your Content does not include photos of children; and
if other people appear in a photo, you have the right to upload it for this use.

Do not upload anyone else’s photos or clothing images unless you have that right.

We do not claim ownership of Your Content, and we do not use it for advertising without your consent. If you delete items or close your account, we will remove Your Content from the live Service as described in the Privacy Policy. Residual copies may remain for a limited time in backups.

6. Acceptable use

You may not:

use the Service for anything unlawful, or in a way that violates these Terms;
upload content that you do not have the right to use, including photos of other people without permission;
upload sexual, exploitative, or otherwise prohibited images of minors, or any content we reasonably consider abusive or harmful;
try to access another person’s account or wardrobe;
interfere with or disrupt the Service; or
scrape, copy, or misuse the Service except as allowed by these Terms or by law.

We may remove content or close accounts that we believe violate this section.

6A. Circles

Circles are private groups where friends you invite can see what you share with them: pieces and looks from your wardrobe, comments, hearts, and votes. Everyone in a circle can see your first name and anything you post there.

When you join or start a circle, you agree to the circle guidelines. We have zero tolerance for objectionable content or abusive users. In a circle you may not:

bully, harass, threaten, or demean anyone, or post hateful content;
post nudity or sexual content, or photos of anyone without their permission;
spam, advertise, or sell; or
share anything else that breaks section 6.

We filter some language automatically. Anyone in a circle can report a post, comment, option, or member, and can block another person so that neither sees the other's content in circles. We review reports within 24 hours. When content breaks these rules, we remove it and may remove the person who posted it from the circle or close their account.

7. AI features

Some features send Your Content to third-party AI providers so the Service can identify garments, generate catalog-style images, and suggest outfits. Those outputs can be wrong, incomplete, or unlike the real item.

AI results are for personal convenience only. They are not professional fashion, fit, safety, or purchasing advice. You are responsible for how you use them.

Third-party providers have their own terms. We do not control how they operate.

8. Our rights

The Service, including its design, software, and trademarks, belongs to Atelier or our licensors. These Terms do not give you any ownership of the Service. You may not copy, reverse engineer, or reuse the Service except as allowed by law.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ATELIER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT TAGS, IMAGES, OR OUTFIT SUGGESTIONS WILL BE ACCURATE OR THAT THE SERVICE WILL MEET YOUR NEEDS.

SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS. IN THAT CASE, THE DISCLAIMER APPLIES ONLY TO THE EXTENT PERMITTED.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATELIER AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR LOSS OF USE, ARISING FROM THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US

00) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.

THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER NEW YORK OR OTHER APPLICABLE LAW.

11. Indemnity

You will defend and indemnify Atelier and its operators against claims, damages, and reasonable legal fees arising from Your Content or your use of the Service in violation of these Terms, except to the extent caused by our own misconduct.

12. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. You and Atelier agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York, except where applicable law gives you the right to bring a claim in another forum.

13. Changes

We may update these Terms from time to time. The revised Terms will be posted at https://www.atelierstudio.ai/terms. If a change is material, we will provide additional notice appropriate to the change. Continued use after the effective date constitutes acceptance, except where law requires opt-in consent.

If a part of these Terms is found unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and Atelier about the Service.
